The promoter is Tasmanian Water & Sewerage Corporation Pty Ltd ABN 47 162 220 653 (TasWater) whose registered office is at 169 Main Road Moonah TASMANIA 7009.
1. Information on how to enter, mechanics of entry and the prize form part of these Terms and Conditions. Entry into the promotion is deemed acceptance of these Terms and Conditions. Entry is via the internet only, via the TasWater website "www.yoursay.taswater.com.au/world-toilet-day".
2. Entry is open to:
a. People who reside in Tasmania, are over the age of 18 years; and
b. successfully complete the survey with TasWater at the time of entry into the promotion.
3. Directors, management and employees (and their immediate families) of TasWater are ineligible to enter this promotion. Immediate family means family residing with the TasWater employee.
4. The promotion commences at 12.00AM (AEST) on Wednesday 30 October 2024 and ends at 11.59 PM (AEST) on Tuesday 19th November 2024 (“Promotion Period”).
5. To enter the promotion the Entrant must, during the Promotion Period access "www.yoursay.taswater.com.au/world-toilet-day" (Promotional Website) and fully and correctly complete and successfully submit the online entry form in the manner required, including providing the Entrant’s name, residential postcode and suburb, a valid phone number and a valid email address.
6. Only one (1) entry per person is permitted. Any subsequent entry of an Entrant after the first valid Entry is received from that Entrant will be deemed invalid.
7. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. Contact details entered incorrectly by an Entrant on their entry form will deem the entry invalid.
8. Costs associated with accessing the TasWater website remain an Entrant's responsibility and may vary depending on the Internet service or telecommunication provider used.
9. All eligible Entries received throughout the Promotional Period in accordance with Conditions 5 (How to Enter) will be drawn randomly via (an online auto number generator using each entrant’s email address) on Wednesday 20th November 2024 at TasWater Head Office, 169 Main Road Moonah TASMANIA 7009, to determine three (3) winners.
10. The three winners will be notified in writing by email and phone within three (3) days of the draw and the name and location of each winner will be published on the TasWater website "www.yoursay.taswater.com.au/world-toilet-day" and via Facebook @TasWater (Facebook account) and will remain on the website for no less than 28 days and on Facebook accounts in perpetuity.
11. The three (3) winners will each receive a digital gift voucher for use at 'Who Gives A Crap' ("https://au.whogivesacrap.org/collections/all") to the email address provided at the time of entry to the amount of AUD$250.00 (two hundred and fifty dollars).
12. No part of the prize is exchangeable for cash or any other prize. The prize is not transferable to another email address or person.
13. If the promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures, directions of regulators or industry self-regulatory bodies or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide alternative prize(s) to the same value as the original prize(s), subject to any written directions made under applicable legislation.
14. The Promoter exclude all liability (including negligence) except for any liability that cannot be excluded by law (including any applicable consumer guarantee under the Consumer Law), for any direct or indirect injury, loss and/or damage arising in any way out of the promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prize(s); and/or (iv) acceptance and/or use of any prize.
15. All of the Promoter’s decisions in respect of the promotion are final and no correspondence will be entered into.
16. TasWater (“we”, “our”, “us”) are bound by the Personal Information Protection Act 2004 (Tas) and the Australian Privacy Principles under the Privacy Act 1988 (Cwlth). The information you provide to us will be used to provide water, sewerage and ancillary services to you, which includes customer communication, account billing and concessions, development applications and handling of complaints. We will only disclose your personal information to a third party, such as contractors and agents we engage to perform or assist in a relevant function or activity, if it is required in the provision of services to you. We will not disclose your personal information to anyone else, unless you have given consent, or we are authorised or required by law to do so. Our Privacy Policy describes when this might occur. Providing us with the requested information is not required by law. If you choose not to provide us with your personal information, we will be unable to process any applications or complaints and may not be able to provide you with water, sewerage and ancillary services. We will manage your personal information in accordance with the Personal Information Protection Act, the Australian Privacy Principles and the Privacy Act 1988.
